Msuya killers file appeal against death sentence

Moshi. Five convicts, who were recently sentenced to death by hanging for killing businessman Erasto Msuya, have tabled a notice of appeal at the Court of Appeal, challenging the death penalty handed down against them.

Moshi Zone High Court deputy registrar Frank Mahimbari was not immediately available yesterday to comment on the appeal, but lawyer Hudson Ndusyepo who was defending Sharifu has confirmed about the move. However, Mr Ndusyepo advised that lawyers Majura Magafu or John Lundu should be sought to comment on the issue because they were among the defence lawyers in the case.

Speaking to The Citizen yesterday, Mr Magafu, who was among the four defence lawyers, admitted tabling the notice of appeal at the High Court of Tanzania.

According to him, once the High Court has worked on the notice of appeal documents and dispatched them to the Appellate Court, the latter will give them copies so they can give the reasons of appealing.

The late Msuya, who was owning several investment enterprises in Arusha City, was shot dead on August 7, 2013 in the area of Mijohoroni, Hai District.
