Court orders arrest of prominent businessman Chavda allegedly for violating bail conditions
Dar es Salaam. The Kisutu Resident Magistrate's Court has issued a warrant for the arrest of prominent businessman Pravinchandra Chavda (75) after he failed to honour bail conditions in his case of giving false information to the Dar es Salaam Special Zone Police.
The court has also summoned the accused's sureties to explain why they didn’t bring the defendant to court.
Mr Chavda, a resident of Upanga in Dar es Salaam, faces four charges, including giving false information to the Central Police Station in Dar es Salaam in an attempt to obtain a police report for the alleged loss of five land title deeds.
He is accused of using the said report fraudulently to acquire the said plots of land. The court’s Principal Magistrate, Aaron Lyamuya, took the decision on Friday, November 22, 2024, after the defendant had failed to appear in court without notice.
In another development, his sureties also failed to appear in court to provide details of the accused’s whereabouts.
The Prosecution requested the court to serve the defendant with an arrest warrant after violating the bail conditions.
Speaking at the court, Senior State Attorney Grace Mwanga said that the case had been called for mention, pending proceedings reviews, which had been submitted to the High Court for assessment and a ruling.
"However, I have neither seen the defendant in court nor his sureties. I have no information on their whereabouts; therefore, I request the court to issue an arrest warrant," stated Senior State Attorney Mwanga.
She also requested the court to give a summons to Chavda’s sureties to explain why they had failed to bring their client to court or provide information about his whereabouts.
Magistrate Lyamuya agreed with the Prosecution and issued the arrest warrant for the accused and a summons for the sureties.
He then adjourned the case to December 17, 2024, when it will come up for mention. The defendant is accused of fraudulently obtaining plot number 1814 located at the Msasani Peninsula in Dar es Salaam, a crime claimed to have been committed on January 10, 2022.
He allegedly submitted a land transfer document to the Registrar of Titles, pretending to be the Sole Investment Company CEO that owns the plot, while knowing the act was false.
On October 7, 2019, at the Dar es Salaam Special Zone Police Station, Mr Chavda is accused of giving false information regarding the loss of five land title deeds, intending to obtain fraudulent reports of the missing titles when he knew the information was false.
The defendant is also alleged to have forged a document called a "Board Resolution," attempting to pass it off as genuine and issued by the Director of Point Investment Limited, the plot owner, while knowing it was not true.
Further, it is alleged that on January 10, 2022, in Dar es Salaam, he presented the forged document to the Registrar of Titles, claiming that he had bought plot number 1814 at the Msasani Peninsula in Dar es Salaam.
