Prosecution closes presentation of evidence in gang-rape case

Dodoma. The prosecution has concluded evidence presentation in a gang-rape case that sparked outrage in Tanzania.

The high-profile criminal case involves four individuals accused of gang rape and sodomising a young woman in Dodoma.

The case which has drawn public attention, saw a total of 17 witnesses take the stand since proceedings began on August 20 this year, according to defense lawyer Godfrey Wasonga who was speaking to reporters on Friday September 6, 2024.

“The prosecution has now closed its case,” said Mr Wasonga who was speaking to reporters outside the Dodoma court.

"We have listened to all 17 prosecution witnesses and cross-examined them. The case will return for mention on September 13, followed by a ruling on whether the defendants have a case to answer or not, on September 23,” he added.

He said the lawyers will prepare defense if the court finds the accused with a case to answer based on the evidence provided.

The alleged attack in the capital Dodoma in May came to light after a former mayor of Ubungo, Mr Boniface Jacob, posted about it on X on August 4, spurring condemnation and calls for action from rights groups across the country.

The four men -- who were arrested August 9 – pleaded not guilty to allegations of gang rape and sodomising the woman at the Dodoma court.

The accused in criminal case number 23476/2024 are Clinton Damas, an officer with the Tanzania People’s Defence Force (TPDF), known by his nickname Nyundo; prison officer Praygod Mushi; Nickson Jackson, also known as 'Machuche'; and Amin Lema, known as Kindamba. They face charges of gang rape and sodomy in a case that has gripped the nation.

The identity of the alleged victim has not been revealed, with the public prosecution office saying she would be referred to as "XY" in the case.

The next hearing on September 23 will determine the direction of the case as the court decides if the defense needs to answer to the charges.
